A few days ago there was a soft LUD on my spouses and my I485 applications. I am the primary applicant and I also had a LUD on my I140(approved in 2006).
Then a couple of days later the message changed for my spouse and we recieved a physical notice in the mail from USCIS. The notice stated that-
Only my spouses I 485 application was transferred from TSC to NSC. The reason for transfer of the application was "faster processing".
Has anyone had this experience where the derivative application was sent to another service center but the Primary application remained in the original center.
My lawyer says this is normal processing.

My attorney applied for me. I am not sure what needs to be done if you want to apply yourself. AP will be valid for 1 yr and requires renewal every yr.

I thought the "Freedom of Information Act" requires the federal goverment to disclose all data and procedure unless it is exempt by some other laws (list of super spies, for instance). Wouldn't it be possible to using this law to force them to disclose their numbers?
Is there any month by month ombudsman report? I was just thinking It doesn't have too much of use if they report AFTER the number is wasted....
I am not an expert in law but we cannot "Force" the deparment of state to release numbers. However some numbers are already available for 2005 in usage stats.
If they waste numbers in 2006, then they may be recaptured and used in 2007 - ONLY IF - the comprehensive bill or the PACE act passes as both have recapture provision.
Doesnt the ombudsman report show all numbers even today? I thought they did.

My friend has a multiple entry visitor visa for US which is valid till April 2009. However he has to visit in March 2009 and stay till around June 2009.
Can someone please tell if the immigration officer during port of entry will be able to grant him stay of the usual 6 months on current visa even though it is expiring?
Or if not, whether he can apply for new visitor visa stamping before expiry of the current one?

I got fingerprinting notices for both me and my wife within couple of days. I received mine today. For both of us it is scheduled on 3rd March.

Guys Here are my ideas for actions.
Our community is facing basically two types of problems
1) Visa number shortage.
2) USCIS Administrative problems.
Visa Number shortage is not fixable without proper law change.
While USCIS Administrative problems are easier to handle.
I would suggest, after new homeland security secretary (Janet Napolitano) takes office on Jan 20 2009, We should simply take 30 minute appointment.
Sit down with her....and explain her along with "Power point" presentation.
We are highly skilled professionals, so lets tackle these issue very professional way.
We should explain her about following things
- Out of order case processing ( this will fix about 40% of our problems)
Since our case becomes very very predictible.. one can sleep at night without checking their emails from CRIS.
- Timely publication of numbers.
- Proper publication of backlog numbers with details for each category.
- Open communication with IV community just like Ombudsman take calls from public.
- Please add your idea here

This is my first H1-b. My interview was on Jan. 4, 2008 in Toronto and got 221g for administrative review. I faxed my research description the VO requested to US consulate in Toronto on Jan. 7, 2008, got the check finished email today. I keep calling DOS for my status during the waiting time. It may work for my case. It is really a pain time. Good luck to you.

We got an RFE on my wife's I-485 requesting for copy of marriage certificate. Our priority date is August 2005. ND is September 05, 2007.
Anyone else in the same boat? Does this mean USCIS has began processing the 2005 apps?
Not really. There appears to be no orderly fashion. My PD is June 2007 EB2. I got an RFE on My I 485 in May 2008.

I told the postman.
Its been more than 2 weeks and I didnt get any response from USCIS after updating the address.It still shows initial review.
Does anyone know how long it would take for the USCIS to resend the card?
When i filed for my EAD card, they returned my card and I had to open SR by calling 800 number. I received card after 1 - 2 months time frame. Again with USCIS each case is different so hope you get faster.

Paper filing as per the instructions, my friend got the EAD in less than 30 days from the date it was sent to TSC. He was kind of unhappy as he applied 120 days prior to expiry and had 90 days go waste (in terms of filing fees)

Thanks all. I think the labor only says BS + min 3 years experience in related field. What are the chances that if I proceed on Monday, I will get an RFE on this? And would there be anyway I could respond to that RFE successfully?
